Use of Services:-

1. Eligibility

You must be at least 18 years old to use our services. By using our services, you represent and warrant that you have the legal capacity to enter into these Terms.

2. Account Registration

To access certain features of our services, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account information and for any activities or actions under your account.

Payment and Fees:-

1. Billing

You agree to pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. Unless otherwise stated, all fees are quoted in USD.

2. Payment Terms

Payments are due upon receipt of our invoice. In the event of late payment, we reserve the right to charge interest on the outstanding balance at the rate of 1.5% per month or the highest rate permitted by law, whichever is lower.

Confidentiality:-

We take the confidentiality of your information seriously. We will not disclose your confidential information to third parties except as required by law, with your consent, or as necessary to provide our services.

Limitation of Liability:-

To the maximum extent permitted by law, Fiscalnow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from our services; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the services.

Indemnification:-

You agree to indemnify and hold Fiscalnow, its affiliates, officers, agents, employees, and partners harmless from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the services, your violation of these Terms, or your violation of any rights of another.

Termination:-

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. Upon termination, your right to use the services will immediately cease.

Governing Law

These Terms shall be governed and construed in accordance with the laws of INDIA, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms:-

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
